The terms "we", "us" and "our" refer to 3Perfumeers, a brand operated by EUROPA CLICK CONNECT S.R.L. 3Perfumeers operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). 3Perfumeers is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (including our Shipping Policy and Return Policy), constitute a binding agreement between you and us. By visiting or purchasing from our store, you agree to be bound by these Terms.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or province of residence. To complete a purchase, you must provide accurate, current, and complete personal and billing information. You are solely responsible for maintaining the confidentiality of your account credentials.

SECTION 2 - OUR PRODUCTS & LEGAL GUARANTEES

We make every effort to display the characteristics and appearance of our car fragrances as accurately as possible. In accordance with European Union consumer law, all products sold in our store benefit from a statutory legal guarantee of conformity. This guarantee covers any defects or non-conformity existing at the time of delivery. We reserve the right to limit sales quantities or discontinue products at our discretion prior to order confirmation.

SECTION 3 - ORDERS AND CONTRACT FORMATION

When you place an order, you are making an offer to purchase. The receipt of an automated payment confirmation does not constitute our formal acceptance of the order. The purchase contract is officially concluded only when we send you a specific email confirming that your order has been dispatched. If we are unable to accept your order due to stock unavailability or pricing errors, we will notify you and issue a full refund immediately. All purchases are subject to your legal right of withdrawal as detailed in our Return and Refund Policy.

SECTION 4 - PRICES, VAT, AND BILLING

All prices displayed on our website are inclusive of Value Added Tax (VAT) at the applicable rate according to the destination country within the EU, but exclude shipping charges, which will be clearly desglosed and displayed before you finalize your checkout. You agree to provide valid and authorized payment details and authorize us to charge the full amount of your order through our designated secure payment processors.

SECTION 5 - SHIPPING RISK AND DELIVERY

Estimated delivery times generally range from 3 to 7 business days and are provided as guidelines. In accordance with EU regulations, 3Perfumeers assumes full risk of loss or damage to the goods during transit. The risk of loss only transfers to you once you, or a designated third party other than the carrier, take physical possession of the products. If an order is not delivered within 30 days from the purchase date, you are entitled to cancel the contract and receive a full refund.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by 3Perfumeers, its affiliates or licensors, and are protected by Romanian, European Union, and international intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material on the Services without our prior written consent.

You acknowledge and agree that we provide access to such tools ”as is” and ”as available” without any warranties, representations, or conditions of any kind. 3Perfumeers is powered by Shopify Inc., which provides the technical platform enabling us to offer our products online. However, any sales and purchases made in this online store are concluded directly and exclusively between you and 3Perfumeers. Shopify is not a party to the sales contract and, to the extent permitted by applicable law, is not responsible for any aspect of the transactions, shipping, or products.

SECTION 10 - PRIVACY POLICY & DATA PROTECTION

All personal information collected through our Services is strictly governed by our Privacy Policy [LINK], which complies with the European General Data Protection Regulation (GDPR) (Regulation (UE) 2016/679). Because our Services are hosted by Shopify, your data will be processed by Shopify Inc. If an error relates to a fundamental element of a placed order (such as a manifest and obvious pricing error where the price is clearly derisory or wrong), we reserve the right to cancel the affected order prior to contract completion (before dispatch), and we will immediately issue a full refund to the Comprador.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) reproduce, duplicate, copy, extract, sell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) use any robot, spider, scraping, data gathering and extraction tools, AI tools (such as agentic AI), or automated means to access the Services; or (e) interfere with or bypass the security features of the website. We reserve the right to suspend or terminate your account if you violate any part of these Prohibited Uses.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access is from an Agent, such as by mimicking human behavior or circumventing CAPTCHAs; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; and (iv) not circumvent any measure intended to block, limit, or control Agent access.

We may suspend or terminate your access to the Services immediately and without prior notice only in the event of a material breach by you of these Terms of Service, applicable laws, or if your behavior poses an immediate security risk to our platform. For non-material issues, we will provide you with reasonable prior notice. Upon termination, you will remain liable for all outstanding amounts due up to and including the date of termination. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Romania or the courts of the consumer’s country of residence.

For clients with active accounts or ongoing services, material changes will be notified via email in advance. For standard store visitors, the version of the Terms in effect at the exact moment of contract completion (dispatch of order) will govern the purchase transaction.
